Ministry of Finance conduct performance review of heads of-12 banks

The finance ministry would soon initiate a performance review of heads of public sector banks that are under the RBI's Prompt Corrective Action (PCA) as part of the reform process, official sources said.

So far, the Reserve Bank has put 12 public sector banks (PSBs) under watch in view of lagging on certain performance parameters like unexpected level of high non-performing assets (NPAs), low capital level, low return on assets, etc.

These parameters indicate weak financial health of lending institutions and a need to initiate remedial measures to put them on a right course.

Performance review of the top level management of all such banks would be undertaken soon, official sources said.

During the current fiscal, IDBI Bank has been committed the highest infusion of Rs 10,610 crore, followed by Bank of India, Rs 9,232 crore and UCO Bank (Rs 6,507 crore).

Among other PCA lenders Central Bank of India was committed Rs 5,158 crore, Indian Overseas Bank - Rs 4,694 crore; Oriental Bank of Commerce Rs 3,571 crore; Dena Bank - Rs 3,045 crore; Bank of Maharashtra - Rs 3,173 crore; United Bank of India - Rs 2,634 crore; Corporation Ban Rs 2,187 crore and Allahabad Bank - Rs 1,500 crore by the end of 2017-18.

In a notification issued by RBI that time, the mandatory action that would be taken when a bank breaches the risk threshold includes restriction on dividend payment/remittance of profits, restriction on branch expansion, higher provisions, restriction on management compensation and director's fees.

January 26 : Life seems to be fashioned and formed best out of the obstacles that seem unbearable.

A VERY HAPPY REPUBLIC DAY TO ALL.

On this day, 26 Jan....

1697 - Isaac Newton received and solved Jean Bernoulli’s brachistochrone problem. The Swiss mathematician Bernoulli had challenged his colleagues to solve it within six months. Newton not only solved the problem before going to bed that same night, but in doing so, invented a new branch of mathematics called the calculus of variations. Newton, age 55, sent the solution to be published, at his request, anonymously. But the brilliant originality of the work betrayed his identity, for when Bernoulli saw the solution he commented, “We recognize the lion by his claw.”

1784 - Benjamin Franklin expresses unhappiness over eagle as America's symbol. The bald eagle looked more like a turkey, which prompted Franklin to compare the two birds as a symbol for the United States.

1875 - George F. Green of Kalamazoo, Michigan, patented the electric dental drill for sawing, filing, dressing and polishing teeth, described as an "electromagnetic dental tool".

1905 - The world's largest gem-quality diamond was discovered in the Premier mine in Transvaal (a British crown colony that later became part of South Africa). It weighed 3,106 carats, or about 1-1/3 pounds, and was named the Cullinan Diamond in honour of Sir Thomas Cullinan, owner of the mining company.

1911 - Glenn Curtiss piloted the first hydroplane flight at North Island, San Diego, California, with a successful take-off from water and landing on water, rose six feet and flew about two or three hundred yards.

1926 - 1st public demonstration of television by John Logie Baird in his laboratory in London.

1929 - Indian National Congress proclaims goal for India's independence.

1950 - India became a Republic within the British Commonwealth, ceasing to be a British dominion. Constitution of India goes into effect.

1950 - Government of India accepted the National Emblem. It consisted of Head of Lion which is taken from Ashok pillar situated near Sarnath. (The Lion Capital was erected in the third century BC by Emperor Ashoka to mark the spot where Buddha first proclaimed his gospel of peace and emancipation to the four quarters of the universe).

1965 - Hindi Language is accepted as National language of India.

1997 - Delhi becomes the first state in India to enforce a ban on smoking in all public places.

President Kovind's maiden Greets all of Indian citizens on the eve of our 69th Republic Day

This is a day to remember with gratitude the enormous efforts and sacrifices of millions of freedom fighters whose blood and sweat gave us Independence and created our Republic. Above all, this is a day to cherish our republican values.

There are so many more who contribute to our Republic in diverse ways and whom I may have missed mentioning. Happy Republic Day to all of you.

India became a Republic on January 26, 1950. This was the second major milestone in our nation building process. Independence had come a little over two years earlier. But it was with the framing and adoption of the Constitution - and the birth of the Republic of India - that we truly achieved the ethic of equality among all citizens, irrespective of religion, region or community. This ethic of equality complemented the liberty that had come at Independence. And a third principle also defined both the cooperative efforts at creating our Republic as well as the India that we wished to be. This was the principle of fraternity.
Our Constitution framers were men and women with great foresight. They understood the majesty of the rule of law, and of rule by laws. They represented an important phase in our national life. We are fortunate to have inherited its legacy in the form of the Constitution and the Republic.

A happy and equal-opportunity nation is built by happy and equal-opportunity families and communities. Families where girls have the same rights and the same access to education and healthcare as boys. Governments can bring in policies and laws to ensure justice to women - but these policies and laws can only be made effective by families and communities that must hear the voices of our daughters. We cannot shut our ears to their urgings for change.

A civic-minded nation is built by civic-minded neighbourhoods, whether in our cities or our villages. Where we respect the next-door person's space, privacy and rights. Where we do not inconvenience our neighbours - while celebrating a festival or while resorting to a protest or on any other occasion. Where one can disagree with another viewpoint - or even with a historical context - without mocking a fellow citizen's dignity and personal space. This is fraternity in action.

A disciplined and morally upright nation is built by disciplined and morally upright institutions. Institutions that respect their fraternal relationship with other institutions. Institutions that maintain the integrity, discipline and limits of their functioning, without compromising on excellence. Institutions that are always more important than the individuals located there. And institutions where the holders and members make every attempt to live up to the office they occupy as trustees of the people.

In 2020, our Republic will turn 70. In 2022, we will celebrate the 75th anniversary of our Independence. These are special occasions and we must strive, in the manner of the leaders of our national movement and the framers of our Constitution, to build the edifice of a better India - an India where each and every citizen will be able to realise his or her full potential. An India that will reach its deserved pedestal in the 21st century.

Fellow citizens, the promise of a developed India beckons us. This is the new stage of our nation building project on which we have embarked. This is the Republic that our young people need to take forward and enhance - in keeping with their vision, their ambition and their ideals. And their vision, ambition and ideals, I am confident, will always draw inspiration from both our republican values - as well as from our ancient Indian ethos.

With those words, I once again wish all of you a very happy Republic Day. And wish all of you a very bright and fulfilling future.

Thank you

JAI HIND!

Income-tax do not donate over 2000 in cash to political parties

The Income Tax Department today cautioned people against indulging in illegal cash transactions including donating more than Rs 2000 to political parties.

In a bid to clean up election funding, the government early this year had notified 'electoral bonds' that can be bought from specified branches of the SBI and used to donate money to political parties.

According to the scheme, no person should make a cash donation of over Rs 2000 to a political party.

IT Department also added that one should not pay more than Rs 10,000 in cash relating to expenditure of business or profession.

The taxman asked public to say "no to cash transactions" of all these kinds.

It added that contravention of these threshold cash limits "may result in levy of tax/penalty".

"Go cashless. Go clean," the advertisement underlined.

Reserve Bank Of India : RBI Govt may give banks more time to switch to IndAS

The government and the Reserve Bank of India (RBI) may postpone the implementation of new accounting standards for banks because of the legislative changes and additional capital requirements the process would entail, according to three senior officials familiar with the matter.

Banks and non-banking financial companies are due to switch to Indian Accounting Standards (IndAS) from 1 April 2018. They currently follow Indian generally accepted accounting principles (GAAP) standards. Other corporate entities started complying with IndAS with effect from 1 April 2016.

“It is likely that RBI will follow the Irda path and defer the implementation of IndAS starting FY20-21,” said the third of the three officials cited earlier.

Bill, which seeks to criminalise the practice of instant triple talaq (or 'talaq-e-biddat'), will be introduced in Parliament today

Law Minister Ravi Shankar Prasad will introduce the Muslim Women (Protection of Rights and Marriage) Bill that seeks to protect the rights of married Muslim women and prohibits "any pronouncement (of divorce) by a person upon his wife by words, either spoken or written or in electronic form, or in any other manner".

10 things to know about the Bill:

1. It is an important legislation which seeks to criminalise the practice of instant triple talaq, which enables Muslim men to divorce their wives instantly by saying 'talaq' three times in a row. There are many cases in which a talaq was given on phone or even via SMS, much to the agony of the Muslim women.

2. The bill proposes to make the triple talaq practice a punishable offence and describes it against "constitutional morality" and "gender equity". Anyone who pronounces instant divorce "shall be punished with imprisonment for a term which may extend to three years and a fine", the bill proposes.

3. The Bill, prepared by an inter-ministerial group headed by Home Minister Rajnath Singh, makes instant triple talaq or talaq-e-biddat in any form - spoken, in writing or by electronic means such as email, SMS and WhatsApp - "illegal and void" and provides for a jail term of three years for the husband.    It was cleared by the Union Cabinet earlier this month.

4. As per the provisions of the Bill, the husband could also be fined and the quantum of fine would be decided by the magistrate hearing the case.

5. The Bill is being introduced as the practice still continued despite the Supreme Court striking down 'talaq-e- iddat'.

6. The proposed law would only be applicable to instant triple talaq and it would give power to the victim to approach a magistrate seeking "subsistence allowance" for herself and minor children. The woman can also seek the custody of her minor children from the magistrate who will take a final call on the issue.

7. The Supreme Court had termed the practice of instant triple talaq unconstitutional while considering a petition to that effect. The then CJI J S Khehar had directed the government to bring in a legislation in this regard. The Supreme Court judgement found wide support among the citizens, especially Muslim women who welcomed the criminalisation of the practice which made them suffer in family matters.

8.  Not everyone is happy with the criminalisation of instant triple talaq. Clerics and several Muslim organisations, cutting across sects and schools of jurisprudence, have opposed the Bill, terming the government's stand as "uncalled for interference" in the personal laws of the community.

9. The All India Muslim Personal Law Board (AIMPLB) opposed the legislation as it said that the legislation is against the Sharia law and may destroy families if made into a law. The AIMPLB has also alleged that due procedure was not followed while drafting the Bill and all stakeholders were not consulted in an effective manner.

10. Congress leader Salman Khurshid also hinted that he is opposed  to the Bill and hoped that the Congress party did not support it when it came in Parliament. Another Congress leader Kapil Sibal, who represented the AIMPLB in court, had alleged that the central  government is trying to diminish Islamic influence in the society.

Chartered Accountant (CA) of INDIA in great demand as UAE looks to implement VAT

Indian chartered accountants (CAs), who have gone through the rigour of interpreting and implementing the Goods and Services Tax (GST), dubbed the most complicated tax law, are in great demand in the United Arab Emirates (UAE) and other Gulf countries these days. Their knowledge of Hindi has become an added advantage for Indian professionals, as many residents of the Gulf are comfortable with the language.

UAE will be introducing Value Added Tax (VAT) from January 1, 2018. This is similar to the GST, which came into force in India from July this year. After UAE, other Gulf countries will also be implementing the new tax. This has led to a demand for Indian experts to help businesses there understand the indirect tax system. In fact, Indian professionals find the tax in UAE much simpler than the Indian GST.

Chartered accountants from across the country, including Nagpur, are camping at UAE or making frequent trips there to help a host of clients understand the law. In Dubai alone, hundreds of Indian professionals have got assignments with demand for an equal number still there, said sources.

However, the VAT in UAE appears to be easier as compared to GST of India. There are no multiple schedules of rates. All taxable services or goods are charged at 5 per cent. There is a category of zero rate, besides exempt goods and services. Under zero rate category, the business need not pay tax but can claim input credit for the levy paid earlier. Schools are under zero rate, he said.
